1. Acceptance of Terms

By accessing or using Modderr (the "Site" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site. We may change these Terms at any time; continued use after changes constitutes acceptance.

2. No Endorsement by Game Publishers or Platforms

Our services and the offerings of sellers on this marketplace are not endorsed, sponsored, promoted, or affiliated with Microsoft Corporation, Sony Interactive Entertainment, Activision Blizzard, or any other game publisher, platform holder, or intellectual property owner. No such entity has approved, authorized, or sanctioned the content or services offered here. Any use of company, game, or product names is for identification only and does not imply any such relationship.

3. Third-Party Terms of Service and Use at Your Own Risk

Many products and services offered on Modderr may violate or conflict with the Terms of Service, End User License Agreements, or other policies of game publishers, platform operators (e.g., Xbox, PlayStation, Steam), or other third parties. Use of mods, cheats, account services, or similar offerings can result in account penalties including but not limited to warnings, suspensions, permanent bans, or loss of access to games and content.

You use this Site and any products or services purchased through it entirely at your own risk. You are solely responsible for understanding and complying with the rules of any platform or game you use, and for any consequences that result from your use of marketplace offerings. 4. No Liability for Account Actions or Data Loss

Modderr (the operator of this Site) and all sellers on this marketplace disclaim liability for any account suspensions, bans, restrictions, or loss of data (including in-game progress, virtual items, or account access) that may result from your use of products or services obtained through the Site. Such outcomes are between you and the relevant platform or publisher. We and our sellers cannot be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service or any purchased offerings, including but not limited to loss of accounts, data, or access to games or services.

5. Accounts and Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and notify us of any unauthorized use.

6. Purchases, Listings, and Refunds

Listings are offered by third-party sellers. We facilitate the marketplace but are not the seller of record for those items. Payment terms, delivery of digital goods, and any seller-specific policies apply as stated on the listing or in communications. Refund and dispute resolution may be limited by the nature of digital goods; see individual listing and seller policies. We reserve the right to remove listings or suspend accounts that violate these Terms or our policies.

7. Keep Transactions and Communication on the Platform (Buyer Protection)

To protect buyers and ensure accountability, all communication and payments must stay on Modderr. Users and sellers must not:

• Message or communicate outside the platform for the purpose of conducting, completing, or discussing transactions (e.g., moving conversations to email, Discord, social media, or other channels to avoid platform oversight).
• Request or accept payment outside the platform, including asking for additional money via PayPal, Venmo, cash, cryptocurrency, gift cards, or any other method not processed through Modderr.
• Direct buyers to contact them off-platform (e.g., sharing external email, phone, or messaging handles) to circumvent the Site for orders, delivery, or support.

Transactions and communications conducted off the platform are not protected by our dispute or safety processes. Violations may result in account suspension or termination. If a seller asks you to pay extra outside the Site or to move the conversation elsewhere, please report it and do not comply.

8. Prohibited Conduct

You may not use the Site to violate any law, infringe others’ rights, distribute malware, spam, or harmful content, impersonate others, or interfere with the Site’s operation. Sellers must not misrepresent listings or sell material that violates third-party rights or applicable law. Circumventing the platform for payments or communication (see Section 7) is also prohibited. We may suspend or terminate accounts and remove content at our discretion.

9. Intellectual Property

The Site and its design, branding, and original content are owned by us or our licensors. Listings and seller content remain the responsibility of the seller; sellers must have necessary rights to offer their products. We do not grant you any right to game or platform trademarks; those belong to their respective owners.

10. Disclaimer of Warranties

The Site and all content and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Your use of seller offerings is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Modderr and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, accounts, or use, arising from your use of the Site or any products or services obtained through it. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is less. Some jurisdictions do not allow certain limitations; in such cases our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Modderr, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice. Upon termination, your right to use the Site ceases. Sections that by their nature should survive (including liability limitations, indemnity, and dispute resolution) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict of law principles. Any dispute shall be resolved in the courts of that jurisdiction, except where prohibited by law.

15. Changes

We may update these Terms from time to time. The "Last updated" date at the top will be revised when we do. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
